Whenever I see Trump I want to scream at the top of my lungs that I hate his guts.
His 9/11 lie also pisses me off, not just because I’m a New Yorker but also because it is so demonstrably untrue. Yet his idiot base will go along with it, because Fearless Leader said the NYSE was open on 9/12, buh-leve me!
OT, but interesting to me as an expat, college grads with ginormous student loan debts are skipping town to work overseas.
It’s not just recent college grads who have discovered the advantages of working abroad. Many teaching gigs in Asia offer either free lodging or rent assistance, and public transport is often more convenient than driving a car. Those were two of my biggest expenses while living the States, and without those costs, I was left with more disposable income working in China for a fraction of my US income than I was in the States. I crunched the numbers, and I was amazed.
My own kids are lucky enough to have their student loans under control. My daughter will pay her last installment this year, and her husband (who has a well paying job) will finish his in two more. My son, currently between jobs, had a lots of scholarship and grant money, so his payments are not so bad. One of the students interviewed by CNBC had to pay $700 a month to service her loan. Holy sheet.

I was notified that I had been CL’d on the last thread, so one more time… with feeling! :)
We’ve had that bullshit anti-Semitic crap infest our local Republican party here in our small town of Brookings, OR. A local MAGAhead printed up a flyer they are passing out at their usual red tent on our main drag and posting all over the utility poles all over town (against public ordinances but little details like that don’t bother Republicans). The flyer rails against local terrorists known as “INDIVISIBLE 97415” (IOW, local pink hat wearing women who banded together after the Trump protests) who are funded by “GEORGE SOROS”, backing local “DEMOCRAT CANDIDATES” and working to defeat the “TRUMP AGENDA”. Lots of exclamations, bolding, italics, underscoring and yellow highlighting included for extra emphatic emphasis!!! Oh, and some more !!!!!
A good friend of ours who happens to be the sous chef at a local restaurant heard about the flyer and decided to head on over to have a talk with them. Let’s just preface this by saying that he’s not the kind of guy you interrupt and he took advantage of that. I can’t even begin to tell his story but the part where he looks at a the old ladies working the tent and asking them “So you’re OK with your daughters and granddaughters just cooking and having babies and no rights of their own?” just killed me. He told them that their Soros story was “bullshit” and anti-Semetic to boot. He also brought up Republicans embracing white nationalists and encouraging them to act out. He said that every time the men started spluttering, he just cut them off and rolled on over them. He ended it by telling them to check out the bumper stickers on his truck, all local Democrats he is backing. He ended it by saying good bye and walking away while they spluttered (but dared not call him back).
I’m now working on a Republican friend of ours who is starting to get pretty uncomfortable with the direction of his party. This guy is a racist (GOB from JAW-JA) a former prison guard in Cali and even he’s starting to distance himself from voting Republican. I’m working to get him to at least change his registration to small “i” independent. He’s not a bad guy in the sense that once he figured out that I’m not a racist, he cut the bullshit out. We have some pretty good/spirited conversations but he is a person who changes his mind when presented facts, which is sadly a rarity among conservatives.
I haven’t been commenting much because pain (OK, more pain) has made sitting for any length of time very uncomfortable. It seems that an MRI that I insisted I get (over my doctor’s advice) shows extensive disc narrowing in my lower spine from L1 to L4, with impingement at L3. The Doc thought more exercise would fix things up but after a couple of weeks of that I told him that while exercising is good, I’m in reasonable fit shape. My other question to him was when would the grinding and pain in my lower spine stop? He finally agreed to the MRI and the day afterward his nurse called me, gave me the results and told me that they were referring me to a neurosurgeon. The neuro is now reviewing the MRI and we’re waiting for his recommendation.
At least the Doc finally let loose the painkillers (5 Mg. Oxycodone 4X a day) which when combined with 400 Mg. of Advil 3X a day, allows me to keep moving and getting shit done. I’ve also added in 225 Mg of CBD (75 Mg. 3X a day), which makes a big difference in keeping the inflammation down. I’m still able to work and get stuff done around the house but I have to be careful or I’ll be flat on my back again. Sitting for any length of time sucks though but that’s the least of my problems…lol!
Regarding the synagogue shooting; Trump, the Republican party, Fox News, and the knuckledragging base (like our locals) who have been pushing the bullshit Soros conspiracy stories have the victims blood on all of their hands. They can proudly proclaim “We built this!” when it comes to the hate and division they have sown across our nation. Sometimes some pushback is all that is needed. My wife has a friend that I’ve mentioned here before. Her friend doesn’t like to come over as much lately since I tend to talk politics at times (appropriate times, she just doesn’t like what I’ve said). They recently went out with another friend of theirs, a older lady who has no qualms about talking about stuff that makes my wife’s friend uncomfortable (their older friend is an avowed Democrat who despises Trump). My wife told me afterward that they both plied their uncomfortable friend with the latest in Trump and Republican crap and this time she tried the “But I’m not like that!”, to which they responded with “We know! Why are you voting for this crap?!”
Her defense was that she was voting as her husband did. They pointed out that no matter what he says, public perception is that Republicans are snuggling up to white nationalists, anti-Semites and outright NAZI sympathizers while attacking minorities, immigrants and women’s rights and our very form of government. My wife doesn’t know if she will change her mind but the good news is that her friend says that she’s tired of her husband listening to Fox News all day and night and then ranting about it afterward (He’s retired, she’s taking a break from work).
If we can reach out to the ones not in it too deep and get through to them, we can reduce the numbers of the Republican base.

Well, locally, I have to deal with the facts on the ground. Those facts are my town is overwhelmingly Republican supporters, many of who don’t really understand the Republican platform and agenda and pull the (R) lever (figuratively, since we have mail voting) because they always have.
It was uplifting to talk with our former mayor yesterday morning, saying he thought I would win reëlection here in a landslide (well, a landslide is a few dozen votes). We’ll see … it isn’t over until it’s over and the county clerk and Secretary of State certify the results. (I still have my framed letter from the state from the last election on my “love me” wall stating I was certified as winning the last election in my town - and my terms run in the midterm elections.)

As much I scorn new-fangled cooking methods, I did break down and buy a Chinese version of the Instant Pot, which is itself nothing more than a pressure cooker with a “brain.” I had left my rice cooker behind when I moved to my new city, because one came with the old apartment and I had replaced it myself. My new accommodations did not provide a rice cooker, so I decided to go a step further and get the “smart” pressure cooker. It cooks rice in half the time and I can cook lots of other stuff in it besides.
I also have a microwave, a tea kettle and an induction cooker. The university thoughtfully provided a wok, two steel cookpots and an aluminum fry pan. Guess which one doesn’t get hot.

As much I scorn new-fangled cooking methods, I did break down and buy a Chinese version of the Instant Pot, which is itself nothing more than a pressure cooker with a “brain.” I had left my rice cooker behind when I moved to my new city, because one came with the old apartment and I had replaced it myself. My new accommodations did not provide a rice cooker, so I decided to go a step further and get the “smart” pressure cooker. It cooks rice in half the time and I can cook lots of other stuff in it besides.
I also have a microwave, a tea kettle and an induction cooker. The university thoughtfully provided a wok, two steel cookpots and an aluminum fry pan. Guess which one doesn’t get hot.
No guesses. I bought a stainless steel chicken fryer that I thought would work great on the induction burner. I knew it had a big aluminum plate in the bottom, but it was plated with steel all the way around. Imagine my surprise when it didn’t work at all.
In my defense, we had a saucepan with the same type of construction and it worked fine.

Currently 50 here, expected to be 61 today. Pretty much normal for the south Oregon coast. In fact, it’s mostly 50’s to 60’s here just about all the time. We get our brief dips and peaks in the winter and summer but otherwise it’s as I said above.
It may rain a bit here at times but at least I don’t have to scrape ice from my car windows or shovel snow!

Jus soli has been baked into federal law since 1898. Every SCOTUS since then has relied on US v Wong Kim Ark as precedent. Yeah, but McCain wasn’t born in the Canal Zone. That was the campaign’s original story until it was pointed out that the hospital he was supposedly born in wouldn’t be built until 20 years later. He was born in Colón—outside the CZ. I guess he believed the urban legend—like I did, admittedly—that you couldn’t be President if you were born outside US jurisdiction, even if your parents were citizens. The lie should have ended his campaign right then and there, though.

A simple point as we start the morning. The President can’t end birthright citizenship by executive order. This is a completely ridiculous idea, a sort of clown-show trial-run at rule by decree. No one with any credibility, let alone legal experts think an executive order can end birthright citizenship. There has been a push on the right to change this practice by passing a law through Congress, specifically revising Immigration and Nationality Act. This too is dubious at best, though it has been proposed and with a sufficiently partisan Supreme Court anything can be done. The change to legislate a change is best scene as a stunt not real lawmaking.

As this historian explains in this thread, birthright citizenship was the default assumption in American law before the 14th amendment. (I strongly recommend reading that thread.) The only question was whether or not this framework was limited to white people. The debates surrounding the language makes clear that birthright citizenship specifically was what the amendment’s authors had in mind and that the need for the language was to apply it to people regardless of race. As a matter of policy you can make any arguments you want. As a matter of what the authors intended (i.e., an originalist argument) it’s really open and shut.

And IMHO, no court could argue against that, because the Constitution squarely grants the authority to select the President to the Electoral College and Congress, not the courts. That’s a big reason why I think SCOTUS erred in Gore v. Bush.

Chester A. Arthur wasn’t born in Canada. That was the original birther slur.
His family lived in Vermont within a mile of the Canadian border. People used to cross back and forth across that border (and the Mexican one) all the time without border controls, because freedom.
When Chester A. Arthur ran for office, that lie was dredged up specifically to call into question his ability to hold office. Note those never making the claim took it to court (where it would have been blown apart.)

Nope. Birthright citizenship is not defined in the Constitution (aside from the XIX Amendment granting citizenship to freed slaves). It is defined in court cases, which can be overthrown by legislation.

Almost anyone in the country, unless explicitly given diplomatic immunity of some sort, is ‘subject to the jurisdiction of the United States’. If you’re in the US, you’re in its jurisdiction. Full stop.

That’s why conservatives have sought to remove the XVII Amendment (direct election of senators) and the XIX Amendment (women’s suffrage).

I was just telling a distant relative on my mom’s side about how the city of Pittsburgh helped shape my identity. And I’m not just talking about as a lover of awesome greasy foods like pierogis and Primanti brothers sandwiches but of how looking at people as people beyond class, religion, and nationality. It can also be argued to mean an undocumented immigrant (since the only thing that person is subject to is deportation to his or her own country).

One thing I liked studying in college was how you have differences even within the same ideology. I was particularly interested in the differences between the three big fascist movements of Europe: Mussolini’s Italy, Hitler’s Germany, and Franco’s Spain. All had a lot in common but there were some subtle differences just like the USSR and PRC had its differences as well and even individual leaders i.e. Khrushchev differing from Stalin and Deng from Mao. The same today applies to how someone like Trump differs from Bush. Bush’s idea of America wasn’t racially or even place of birth based. Bush for all my faults with him and man I have tons believed in the America as an idea where your desire to be an American matters more than you were from originally and that’s a key point where Trump differs from the conventional conservative Republican of the past 50 years. It doesn’t mean that conservative Republicans of the past 50 years were admirable but rather that many including Bush and even Reagan got what it meant to be an American.

His ruling on the ACA was narrowly defined as Congress’s authority to impose a tax (he held the individual mandate as a tax). Any tax Congress imposes, another Congress can take away.
That is true. I honestly have no idea how he’d rule. I’m just pointing out that birthright citizenship has been on the books a long time. Every person born in this country right now is a citizen because of it. I’m not saying it can’t happen. My gut instinct as a paralegal is like that of CD’s and I think it won’t happen but I’ve been proven wrong unfortunately before.

Appeals court you mean. Also a really, really weird case since the island has legal stuff in place that would be utterly unconstitutional anywhere else. So the folks there are considered nationals, but not citizens according to the agreement when the island came under US control.

American Samoa has been a U.S. territory since 1900. The U.S. Congress previously has decided on a territory-by-territory basis whether people born in the various overseas territories including Puerto Rico, Guam, the U.S. Virgin Islands and the Northern Mariana Islands automatically become U.S. citizens. American Samoa was the only one denied birthright citizenship.

Mainstream: The view a majority of a group hold.
Very few conservative voters I’ve met in my life to not hold that view. Just because politicians don’t openly speak of it doesn’t make it not mainstream.
That is why I brought up Lee Atwater (in the context of racial politics). When it became -ah- unfashionable for a politician to speak openly about racial segregation, the “Southern Strategy” was born. Even today conservative politicians are occasionally exposed as members of the League of the South or Council of Conservative Citizens.

Very few conservative voters I’ve met in my life to not hold that view. Just because politicians don’t openly speak of it doesn’t make it not mainstream.
That is why I brought up Lee Atwater (in the context of racial politics). When it became -ah- unfashionable for a politician to speak openly about racial segregation, the “Southern Strategy” was born. Even today conservative politicians are occasionally exposed as members of the League of the South or Council of Conservative Citizens.
Again I’m not disagreeing. I just don’t remember a majority of Republican voters holding this view in the past. And yes I know about Atwater and his “You start out saying n-word, when that doesn’t work, you start opposing busing, and then what doesn’t work, you start talking about lower taxes and cutting social services.” I’m just saying that I don’t think this is a mainstream position of conservatives the past 40 years. I really disagree with you on that one. But I do agree with your premise that the GOP base has been more extreme than the elected officials and it is my opinion that the elected officials growing more extreme is part of why we’ve gotten into this fine mess.

It’s astroturf. Outfits like that always are. The TEA party managed to be a true grassroots thing for all of two weeks before it was taken over and became another GOP fund raising cash cow. The nature of the GOP means actual grass roots organizing is anathema. The model is strictly top-down messaging and control. I did a research paper on that a few years ago concerning conservative vs progressive models of community involvement in education. GOP stuff was always dictated from outside the community and obedience was expected. Local concerns disregarded and followers expected to adopt culture war battle plans dictated from leadership.

Nope. Birthright citizenship is not defined in the Constitution (aside from the XIX Amendment granting citizenship to freed slaves). It is defined in court cases, which can be overthrown by legislation.
If originalism means anything, a statute cannot change the meaning of the Constitution. But of course many conservatives are only originalists when it suits them.

The current conservative legal argument is that illegal immigrants are only partially subjected to US jurisdiction. The US cannot draft an illegal into it’s military, cannot prosecute an illegal for treason since they owe us no allegiance, etc etc.
It is a pretty thin argument, but I could totally see the right court going for it. In this case I don’t think Roberts would bite, he seems to be at least a little bit concerned about the courts legitimacy and legacy.
Well as discussed in Wong Kim Ark, “not subject to the jurisdiction of the US” was meant very literally. It exempts diplomats in the US, because by international law embassies are foreign soil and diplomats have immunity from local laws. It exempted Native Americans,, because they were members of sovereign tribes. And it exempted the children of foreign soldiers in hostile occupation of national territory since the nation can’t exercise authority over territory controlled by an enemy army. Unauthorized immigrants obviously can be arrested and punished for violating US laws. Any Court trying to twist that language to apply to unauthorized immigrants would truly be an activist court, not merely applying it as the framers intended, which conservatives claim to do.
